Privacy Policy

This Privacy Policy governs the way Malachite collects, uses, maintains, and discloses information collected by users of the Malachite Service. This Privacy Policy applies to the Service and all products and services provided by Malachite.

Personal Identification Information

Malachite collects information about users' personal identity in various ways, including but not limited to the times the user visits the service, registering in the Malachite service, filling out an application, filling out a survey form, and other activities, services, features, or resources that we may provide on our service. Users may also be asked to provide their full name, email address, phone number, and credit card information.

Non-Personally Identifiable Information

Malachite collects certain information about users wherever they interact with the service. This information is not related to personal identification but may include technical information about the user's methods of connection to the service, such as the company used to provide the Internet service and other similar information.

Malachite Mobile Application

The Malachite mobile application for Android and iOS (com.creadev.malachite) is used by employees of the organizations that deploy Malachite ("your employer"). In addition to the information described above, the app collects the following:

Location data (precise and approximate). The app collects GPS and network location — latitude, longitude, accuracy, and whether the reading came from a mock-location app — in order to record your attendance automatically, to confirm that check-in and check-out take place at your assigned work site, and to provide your employer with a presence log for your shift. The mock-location check exists to detect falsified locations and protect the integrity of attendance records.

Location is collected when you check in or check out, and — only if you switch location tracking on — repeatedly for the duration of your shift, including while the app is closed, running in the background, or not in use.

Location tracking is switched off by default. Before it is enabled for the first time, the app shows you a disclosure stating that Malachite collects location data to record your attendance automatically and to share your work location with your employer, even when the app is closed or not in use; tracking begins only if you accept that disclosure and grant the location permission. While tracking is running, the app displays a permanent notification reading "Malachite is sharing your location with your employer" for the entire time collection is active. You can stop tracking at any time from the app's home screen, which stops collection immediately, or withdraw the permission in your device settings (Settings → Apps → Malachite → Permissions → Location on Android). Background location is used solely for the attendance and presence-log feature described here, and no location data is collected while tracking is switched off.

Face images and facial-recognition data (biometric data). Where you use face-based sign-in, or face-verified attendance enabled by your employer, the image captured by the camera is sent to the Malachite service and processed using facial-recognition technology to compare it with the reference face registered for your employee record and confirm a match. Face recognition is optional: signing in with your username and password, and attendance methods that do not use face verification, remain available where your employer enables them. Face data is used only to verify your identity.

Camera. The camera is used to capture the face image described above and to attach photos to requests when you choose to do so. It is used only while a capture screen is open in the foreground, never in the background.

Device identifier and device information. The app collects an installation/device identifier, the device model, the operating-system family and the app version, in order to associate your session and your notifications with your device, to support the app, and to help prevent unauthorised access to your account.

Push notification token. The app registers a device notification token so that notifications such as request approvals, shift reminders and attendance alerts can be delivered to your device.

Diagnostic and error logs. The app records crash and error information so faults can be detected, diagnosed and fixed.

The mobile app does not collect your contacts, messages, call logs, photo library, browsing history, microphone audio or advertising identifiers. Data collected through the app is not used for advertising and is not sold.

Retention. Attendance records, location readings and other employment data are retained for as long as your employment relationship requires and for any longer period required by applicable law, after which they are deleted or irreversibly anonymised. Face images captured for a verification are kept only for as long as is needed to perform and audit that verification. Diagnostic logs are kept for a limited period and then deleted.

Your controls. You can withdraw location and camera permissions at any time in your device settings. Because data in the mobile app is processed on your employer's behalf, requests concerning your employment records are usually best directed to your employer's HR department; you may also contact us using the details in Contact Us above.

Append to the existing Sharing Personal Data section:

Your employer — the organization whose Malachite account you sign in to receives your attendance records, the location readings collected while tracking is switched on, face-verification results, your requests and related employment data. This sharing is the purpose of the app.

Service providers — trusted service providers may process limited information on our behalf where necessary to host, operate, secure and support the Malachite service, deliver device notifications, and provide identity-verification functionality. These providers may use the information only to provide the relevant services to us and in accordance with applicable contractual and legal requirements.

How We Use the Information Collected

Malachite collects and uses users' personal information for the following purposes:

    Your information helps us more effectively respond to your customer service requests and support needs.

    We continually strive to improve the offerings provided through the Service according to the information and feedback we receive from you in order to better understand the interests and needs of users of our Service.

  • 3) ) Sending emails periodically :

    The email address that users register to process their order will only be used to send them information and updates related to their order. It may also be used to respond to inquiries or other requests and questions.

    If the user decides to join our mailing list, they will receive emails that may include Malachite news, latest updates, and information related to the service. If at any time the user wants to cancel the ability to receive any future messages, we provide them with detailed instructions on canceling the registration at the end of each message via email, or the user can contact us through the service or our website.

How We Protect Your Information

We follow proper procedures and security standards in collecting, storing, and dealing with data to protect that data against unauthorized handling, modification, disclosure, or destruction of your personal data, user name, password, information related to your transactions, and the data stored on our service. Sensitive and private data is exchanged between Malachite and its users through secure communication channels and is encrypted and protected through approved digital methods and techniques.

Sharing Personal Data

We at Malachite do not sell, trade, or rent users' personal identification data to third parties. We may share information and users with our partners, affiliates, and advertisers as users of our service. We may use third-party Service Providers to assist us in conducting our business and operating the Service or to administer activities on our behalf, such as surveys. Your data may be shared with these third parties for those specific purposes.

Third-Party Websites

Users may find advertisements or other content on our Service that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors, or other third-party entities. It should be noted that we do not control the content or links that appear on those sites, and we are not responsible for the practices carried out by sites linked to our site. Additionally, these sites or services, including content and links, may be constantly changing. These sites and services have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites that have a link to our Service, is subject to that website's own terms and policies.

Changes to the Privacy Policy

Malachite has the discretion to update this Privacy Policy at any time. When we do, the user should review the update date at the bottom of this page. We encourage users to frequently review the Privacy Policy for any changes so that they are aware of how we are protecting the personal data we collect. The user acknowledges and agrees that it is their responsibility to review this Privacy Policy periodically and be aware of any modifications.

Agreement to the Privacy Policy

By using this service, you agree to our privacy policy and the terms and conditions that govern the use of this service. If you do not agree to this policy, you must not use our Service. You acknowledge that your continued use of the service after announcing changes to this policy or to the terms and conditions of use of the service will be considered your acceptance of these changes.
